Terms & Conditions:

Definitions

  • · “Booking Confirmation” means written confirmation from us that your booking on a course is confirmed.
  • · “Brewers Decorator Academy” means the training service for decorators provided by C. Brewer & Sons Limited.
  • · “Course” means a training course or courses provided by Brewers Decorator Academy on which you enrol, or on which you enrol your employee.
  • · “Photo ID” means a clear photocopy or electronic scan of your passport or photographic driving licence.
  • · “RAMS” means Risk Assessment Method Statement.
  • · “SSOW” means Safe System of Work.
  • · “Terms” means these terms and conditions for training courses.
  • · “you” / “your” means you, the delegate enrolling on a course provided by Brewers Decorator Academy, or the person enrolling an employee as a delegate on such a course.
  • · “CITB” means the Construction Industry Training Board, the awarding organisation which supports and develops the standards for this course.

Booking Arrangements

1. On receipt of your booking request, we will send a personal information form via Microsoft Forms to you (or to the delegate, if booked by an employer). Once this form has been completed and returned to us, we will issue a Booking Confirmation. A legally binding contract is created between you and us upon the issue of this confirmation.

2. Full payment of the course fee must be made via our credit/Debit card payment system at the time of booking. A payment confirmation will be sent to the email address provided on the booking form.

3. You agree to provide your (or the delegate’s) Photo ID at the start of the course during the induction period. This ID will only be used to verify your details for CITB purposes and will not be photocopied or retained. Without valid ID, you may attend the course but will not be eligible to receive certification. 4. Delegates must be over the age of 18 due to use of specific equipment, and a basic knowledge of painting and decorating terminology and techniques is required

5. We reserve the right to decline any booking request at our discretion.

Course Arrangements

5. We will make reasonable efforts to accommodate any adjustments needed to enable full access to our courses. Please notify us of any such requirements at the time of booking. Due to the nature of the training, there may be situations where adjustments are not feasible. You are responsible for ensuring that you are fit and able to undertake the course. Refunds will not be issued for non-disclosure of relevant medical conditions or disabilities.

6. A fee may be charged for implementing reasonable adjustments. This will be discussed and agreed with you in advance.

7. You agree to cooperate with us to ensure the health, safety, and welfare of all individuals attending the course, in accordance with the Health and Safety at Work Act 1974 and any other applicable legislation.

8. A full health and safety briefing will be provided at the start of the course. This will include emergency procedures, first aid information, and facility details such as toilets and break-out rooms.

9. RAMS and SSOWs are in place for all training courses and related activities. Copies are available on request.

10. We will provide any necessary PPE required for the course. You may bring your own if preferred. Please wear appropriate work clothing and footwear (steel toe-caps are not required).

11. When using powered equipment, you must follow all instructions and operate equipment with due care. Compliance with all health and safety guidance and SSOWs is mandatory.

12. We reserve the right to refuse entry to any person suspected to be under the influence of alcohol or drugs.

13. We operate a zero-tolerance policy towards harassment or abuse of any kind, including behaviour directed at staff, delegates, customers, or suppliers.

Travel and Subsistence Costs

14. We do not reimburse travel costs for attending courses. However, we will cover parking expenses if you use the designated car park at Clifton St Car Park, Wolverhampton WV3 0QT (a 2-minute walk from the Academy). To qualify, you must provide your vehicle registration before or upon arrival on the course day. We accept no liability for parking tickets if incorrect details are supplied. Parking will be registered and paid for via the RingGo app.

15. Lunch and light refreshments are included in the course fee. We will make every effort to accommodate dietary requirements if specified at the time of booking.

Cancellations and Refunds

16. We reserve the right to cancel or reschedule courses due to low attendance, trainer illness, or other events beyond our control. In such cases, a full refund will be issued to the original payment card, or an opportunity to amend your course date.

17. If you cancel your booking, the following terms apply:

· More than 28 days before the course date: Full refund or transfer to another date.

· 7–14 days before the course date: 50% refund or transfer to another date.

· Less than 7 days before the course date: No refund. Transfer may be offered subject to availability and at Brewers Decorator Academy discretion.

18. If you are a consumer (not acting in the course of a business), you have a legal right to cancel within 14 days of receiving the Booking Confirmation and receive a full refund. However, if the course starts within that 14-day period, your right to cancel and receive a refund is forfeited.

Liability

19. Except as stated in paragraph 23, we shall not be liable for any accident, loss, or damage caused by you while attending the course.

20. You agree to indemnify us against any third-party claims arising from your actions during the course.

21. We shall not be liable for any direct or indirect loss caused by course attendance or cancellation, except as provided in paragraphs 16 and 23.

22. Subject to paragraph 23, our maximum liability shall be limited to the value of the course fee paid.

23. Nothing in these Terms limits or excludes our liability for:

· Death or personal injury caused by our negligence;

· Fraud or fraudulent misrepresentation;

· Any liability that cannot be excluded by law.

24. All intellectual property rights in materials provided for the course remain the property of Brewers Decorator Academy. These materials must not be copied, shared, or reproduced without prior written permission.

Privacy and Personal Information

25. We will handle your personal data in accordance with applicable data protection legislation and our Privacy Policy, which forms part of this agreement. Your information

will be used solely for course delivery unless you consent to further use (e.g., for marketing or image use). You can opt out of marketing or image use at any time.

Governing Law

26. These Terms are governed by English law. Legal proceedings may be brought in the courts of England and Wales. If you are a consumer living in Scotland or Northern Ireland, you may also bring proceedings in the courts of your local jurisdiction.
